2. The petitioner seeks bail in a case registered for the offence punishable under Sections 126(2), 115(2), 118(1), 109, 103(1), 352, 351(2) and 3(5) of the Bhartiya Nyaya Sanhita.

3. The prosecution case, in brief, as per the First Information Report, is that on 07.09.2025, at about 09:30 AM, all the F.I.R. named accused persons, including this petitioner, had blocked the back path of the informant by keeping a Nad (used for feeding cattle). When protested, all the F.I.R. named accused persons, including this petitioner, started abusing and assaulting the informant and others. Co-accused Amarjit Singh started indiscriminate firing and the bullet hit the father-in-law

4. Learned senior counsel for the petitioner submits that petitioner is quite innocent and has falsely been implicated in this case. Both parties are co-sharers of the path in question and due to pre-existing land dispute, petitioner has falsely been implicated in this case. From bare perusal of the F.I.R. it is apparent that specific accusation of firing is against co-accused Amarjit Singh. So far as this petitioner is concerned, no specific accusation of overt act has been levelled against him. It is further submitted that similarly situated co-accused persons have already been granted the privilege of anticipatory bail by a Co-ordinate Bench of this Hon'ble Court vide order dated 16.04.2026 passed in Cr. Misc. No. 18927 of 2026. Moreover, charge-sheet has already been submitted and petitioner is in custody since 19.04.2026.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the facts and circumstance of the case, general and omnibus nature of accusation, claim based on parity and period of custody, the prayer for grant of bail to the petitioner is allowed.

7. Accordingly, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Siwan in connection with Bhagwanpur Hat P.S. Case No. 381 of 2025.
