The petitioners are apprehending arrest in a case registered for the offences punishable under section 397 of the Indian Penal Code and section 27 of the Arms Act. It is alleged that the informant was robbed and was caused injuries leading to registration of FIR against eight unknown. Though the informant claimed to have identified the accused persons but did not name the petitioners. It is submitted by the learned counsel for the petitioners that though the petitioners are villagers of the informant but they were not named in the FIR. Names of the

Patna High Court Cr.Misc. No.339 of 2016 (2) dt.07-01-2016 2/2 petitioners sprang up in the confession of co-accused Chano Mandal. It is further submitted that there is no recovery from the petitioners. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. The aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioners by the learned court below in case the petitioners surrender within six weeks from today in connection with Beldaur P.S. Case No. 125 of 2015 pending in the court of learned JM Ist Class, Khagaria. This application is disposed of with the aforesaid observation/direction.
