JUSTICE BIRENDRA KUMAR ORAL ORDER 21-12-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 447, 341, 323, 354(B) and 307of the Indian Penal Code.

Allegation is that petitioner, initially, attempted to outrage the modesty of the informant and on protest by the informant, he committed assault at the head of the informant. The injury report reveals that the Doctor has found injury over the parietal area of the informant.

Submission of the petitioner is that injury is simple in nature caused by hard blunt substance and there is no allegation of repetition of blow.

Considering the fact that the petitioner had

No.52972 of 2016 (2) dt.21-12-2016 2/2 knowledge that his act might cause death, I am not inclined to grant anticipatory bail to the petitioner in connection with Barari Police Station Case No. 245 of 2016 pending in the court of learned Additional Chief Judicial Magistrate-V, Katihar. Hence, prayer is refused.
