The petitioners are accused in Mairwa Police Station Case No 189 of 2014 registered for the offences punishable under Sections 302,201/34 of Indian Penal Code.
Complaint case alleges that due to demand of his share in the land, the husband of the complainant has been done to death by his relatives including the petitioners who are elder brother and nephew of the deceased. It is submitted by the counsel for the petitioner that allegations in the complaint petition are general and omnibus. No specific overt act has been alleged against the petitioners. Though the occurrence has taken place on 22.08.2014, the complaint has been lodged after 20 days and even
Patna High Court Cr.Misc. No.55730 of 2017 (2) dt.15-12-2017 2/2 from perusal of the same, the allegations are highly improbable. The petitioners are in custody since 11.01.2017 and have no criminal antecedent prior to the instant case. Having regard to the submissions made on behalf of the petitioners, prayer for bail is allowed. Let the petitioners above named be released on bail on each of them furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge VI, Siwan in Sessions Trial No 362 of 2017 arising out of Mairwa Police Station Case No 189 of 2014 subject to the following conditions:
(1) That one of the bailors will be a close relative of the petitioners who will give an affidavit giving genealogy as to how he is related with the petitioners. The bailor will also undertake to inform the Court if there is any change in the address of the petitioners.
(2) That the petitioners will be well represented on each date and if they fail to do so on two consecutive dates, their bail will be liable to be cancelled.
