2. Petitioner is in custody in connection with Giriyak P.S.Case No.318 of 2015 registered for the offence under section 307 and other ancillary Sections of the IPC.

3. The case has been registered on the basis of the report submitted by Inspector of Police of Giriyak. It is alleged that when he along with police party went to execute the warrant of arrest against this petitioner and other nine accused, this petitioner and other local people resisted the arresting. They pelted stones and thereby facilitated co-accused Ramsaran Yadav to get him freed from the custody of the police.

4. It has been submitted that Ramsaran Yadav who allegedly instigated the local people, has been allowed bail in

Patna High Court Cr.Misc. No.57427 of 2017 (2) dt.12-12-2017 2/2 Cr.Misc.No.45643 of 2016 as per order dated 26.10.2016. The case of the petitioner stands on better footing as he remained in custody for about four months.

5. Learned APP opposed the submissions.

6. Considering the length of custody, prayer for bail is allowed. Let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM, Nalanda at Bihar Sharif in Giriyak P.S.Case No.318 of 2015.
