2. The petitioner has preferred this application for grant of regular bail in connection with Mufassil P.S. Case No. 97/2021 dated 26.01.2021 registered for the offences punishable u/ss 341, 323, 324, 307 read with section 34 of the Indian Penal Code.

3. As per the prosecution case, two unknown miscreants came to the door of the informant and fired 5-6 rounds on her husband causing bullet injuries to him and he fell down there, thereafter they fled away along with the other coaccused persons. It is further alleged that they threatened to compromise the previous case.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is not named in the FIR. The name of the petitioner has sprung up in the confessional statement of the co-accused Gunjesh Kumar Giri. There is no specific allegation against the petitioner of firing. No incriminating material has been recovered from the conscious possession of the petitioner. The petitioner has four criminal antecedents as stated in para 3 of the bail petition. The petitioner is in custody since 10.02.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner by submitting that the petitioner is also involved in the said crime.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Samastipur in connection with Mufassil P.S. Case No. 97/2021, with following condition/s:- (i). The petitioner is directed to remain physically present before the learned Court below on each and every date,
