JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-01-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 170,255,420,467,468,120B and 379 of the Indian Penal Code. The prosecution case is that from the office of the Petrol Pump at G.T. Road, certain forged documents were recovered suggesting that the documents were prepared to evade Sales Tax and V.A.T. in transporting the goods from the State of Bihar. The name of the petitioners sprang up after four months of registration of the FIR at the fag end of the investigation when the witnesses suggested that forged documents were prepared at the behest of the petitioners.

No.181 of 2016 (2) dt.06-01-2016 2/2 It is submitted by the learned counsel for the petitioners that nothing has been recovered from the petitioners and maliciously the I.O. has roped the petitioners in the present case. Considering the suspicious nature of accusation, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned SDJM, Sherghati at Gaya in connection with Barachatti P.S. Case No. 145 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.

The bail bonds of the petitioners will be accepted on filing of an affidavit by the petitioners before the learned court below that they will regularly cooperate in the investigation. The said affidavit will be transmitted by the learned court below to the concerned I.O. Non cooperation in the investigation will give liberty to the prosecution to file application before the learned court below to cancel bail bonds of the petitioners.
