JUSTICE RAKESH KUMAR ORAL ORDER 22-09-2016 Heard Sri Arjun Prasad, learned counsel , who was assisted by Sri Manoj Kumar, learned counsel for the petitioner and Sri Lakshmi Kant Sharma, learned Additional Public Prosecutor.
The sole petitioner, apprehending his arrest in Barahiya P.S. Case No. 163 of 2015, registered for the offence under Section 379 of the Indian Penal Code, has prayed for grant of bail in the event of arrest or surrender.
It was submitted by learned counsel for the petitioner that buffaloes of the informant were stolen and on suspicion petitioner has been made accused. He submits that petitioner's name has come on the basis of confession of one of the coaccused. Even from the accused who was arrested nothing has

Keeping in view the nature of accusation, the fact that name of petitioner has come due to confession of the co- accused as well as clean antecedent of the petitioner , in the event of arrest or surrender within a period of six weeks from today, let the sole petitioner Bambam Yadav be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Lakhisarai / concerned court in connection with Barahiya P.S. Case No. 163 of 2015 subject to the conditions as contemplated under section 438(2) of the Code of Criminal Procedure.
