The petitioner seeks bail in connection with Barbigha P.S. Case No. 123 of 2017 dated 14.03.2017 instituted initially for the offence under Section 364 of the Indian Penal Code but later Sections 302, 201/34 of the Indian Penal Code were also added.

The son of the informant was called on telephone, whereafter he left his home, never to return. Later, his dead body was recovered from near a bush. Prima facie, it appeared to the investigating agency that the deceased had been strangulated to death. In the F.I.R, the informant has stated that one Manish Kumar who was a friend of the deceased had information regarding the whereabouts of the deceased. The name

Patna High Court Cr.Misc. No.55634 of 2017 (3) dt.22-12-2017 2/2 of the petitioner has transpired in the confessional statements of Laxman Kumar and Atal Bihari whose statements have been recorded in para 58 and 59 of the case diary. Beyond the confessional statements of the aforesaid two persons, there is no other material to connect the petitioner with the crime. The petitioner earlier had been made accused in about four cases of minor nature and in all such cases, the petitioner is on bail. Regard being had to the aforesaid facts and the period of custody of the petitioner which is from 23.08.2017, this Court is inclined to grant bail to the petitioner. The petitioner, above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) with sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, II, Sheikhpura in connection with Barbigha P.S.
