2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 8/20(b)(ii) (c)/22(c) of the NDPS Act.

3. The case of the prosecution is that a bike having Registration No. BR 4U 6001 was being driven by one Lallu Kumar and from his bike, 21.371 kg of ganja was recovered.

4. Learned counsel for the petitioner has submitted that his name has surfaced in this case as he is the owner of the bike. It has further been submitted that nothing has been recovered from his possession. He has brought to the notice Annexure-3 which is an application filed in the trial court to the effect that Lallu Kumar has purchased the said bike on

Patna High Court CR. MISC. No.41948 of 2025(4) dt.20-08-2025 2/2 03.02.2024 from the petitioner. The sale letter has also been annexed as Annexure-2 to the same effect. The petitioner is having criminal antecedent of one case in which he is on bail. The petitioner is in judicial custody since 01.05.2025.

5. Learned APP for the State has vehemently opposed the bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with NDPS Case No. 33 of 2024 (arising out of Nokha P.S. Case No. 129 of 2024) on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IV, Rohtas at Sasaram.
