2. The petitioner seeks bail in connection with Jogbani P.S. Case No. 240 of 2023 registered for the offence punishable under Sections 21/22/ of the NDPS Act.

3. This is the second attempt by the petitioner for his bail. Earlier, this Court vide order dated 10.01.2024 in Cr. Misc. No. 83779 of 2023 had dismissed the bail of the petitioner.

4. As per the prosecution case, the following items have been recovered from the house of the petitioner: (i) Pheniramine Maleate injection 532 Nos (2ml each) 1064 ml.

(ii) Lupigestic injection 504 Nos (2ml each) total 1008 ml.

(iii) Phenergan injection 424 Nos (2ml each) total 848

5. The petitioner is in custody since 20.09.2023 and has clean antecedent.

6. Considering the period of custody and clean antecedent of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Session cum Special Judge, NDPS Act, Araria in connection with Jogbani P.S. Case No. 240 of 2023.

7. As a condition of this order, the petitioner, after being released on bail is directed to mark his attendance at Jogbani Police Station on each Sunday of every month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioner. (Sandeep Kumar, J) kiran/- U T
