JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-01-2019 The petitioner apprehends his arrest in connection with Bihiyan P.S.Case No. 238 of 2018 registered under Sections 120B, 414, 420, 467, 468 and 471/34 of the Indian penal Code. Allegation as per the FIR is that police intercepted a stolen motorcycle and arrested one person who in his confession named another accused from whose house also a stolen motorcycle was recovered and on his confession name of the petitioner transpires in this case.

Submission of learned counsel for the petitioner is that petitioner has no criminal antecedent and no recovery is made from his house and he has falsely been implicated int his case. Heard learned APP also.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed,

Patna High Court Cr.Misc. No.72061 of 2018(3) dt.25-01-2019 2/2 in the event of arrest or surrender before the court below within a period of six weeks from the date of order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-V at Ara in connection with Bihiyan P.S.
