10-01-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

Petitioner, in the present case, is seeking regular bail in connection with Nawada P.S. Case No. 376/2012 registered for the offence punishable under Sections 364A of the Indian Penal Code pending in the court of learned Chief Judicial Magistrate, Nawadah. Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. and he has been involved in this case only on the basis of the confessional statement made by the co-accused Sunil Singh. He is in custody since 27.06.2017.

On the other hand, learned Additional Public Prosecutor opposes the prayer for bail of the petitioner and

Patna High Court Cr.Misc. No.63607 of 2017 (2) dt.10-01-2018 submits that this case is of the year 2012 and the petitioner has been remanded in this case recently from the other case in which he was arrested. He pointed out referring to paragraph 3 of the application that the petitioner has got some cases on his head and the nature of the cases are serious.

It is further submitted that from the impugned order it will also appear that this petitioner was there in the Bolero vehicle which was intercepted and in which the victims were lying in unconscious condition. There are also allegations of firing against this petitioner. When the police intercepted the Bolero vehicle, he was fleeing away, some firearms and ammunitions were also recovered from the possession of the co-accused.

Considering the facts and circumstances and the nature of allegation, I am not inclined to grant regular bail to the petitioner.

Accordingly, prayer for regular bail of the petitioner is hereby rejected.
