JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-01-2016 Heard learned counsels for the petitioner and the State. The petitioner being the wife of the brother of the husband of the informant's sister is apprehending arrest in a case registered for the offences punishable under Sections 323, 307, 341, 342, 498A, 504/34 of the Indian Penal Code. The accusation is of torture.

It is alleged that the petitioner tried to strangulate the informant's sister and when the informant came to rescue, then she was threatened of causing injury by dabiya.

Learned counsel for the petitioner submits that the thrust of accusation is against the husband of the informant's sister and the petitioner has been roped in the case being the wife of brother of the husband of the informant's sister.

Patna High Court Cr.Misc. No.138 of 2016 (2) dt.05-01-2016 Considering the nature of accusation and the petitioner being lady, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Araria in connection with Forbesganj P.S. Case No. 510 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
