The petitioner is in custody in connection with Paliganj P.S.Case No.83 of 2016 registered for an offence under Section 387 of the IPC.
It is alleged that this petitioner had threatened and demanded money to the tune of Rs.50,000/- from the informant from the jail over mobile.
It has been submitted that the brother of this petitioner was murdered for which an FIR was lodged by the wife of the deceased vide Paliganj P.S.Case No.101 of 2015. After investigation police submitted chargesheet against this petitioner. One of the named accused Alok Kumar is instrumental in lodging of the present case. In course of investigation, father of Alok
Patna High Court Cr.Misc. No.63044 of 2017 (2) dt.11-01-2018 2/2 Kumar who was named accused of Paliganj P.S.Case No.101 of 2015, has stated that the present informant had taken money from the father of the petitioner and in order to digest the money, this case has been maliciously lodged.
Learned APP opposed the submissions.
In the facts and circumstances of the case, prayer for bail is allowed. Let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of SDJM, Danapur in connection with Paliganj P.S.Case No.83 of 2016.
