The petitioner apprehends his arrest in connection with Bhabhua P.S. Case no. 617 of 2016, registered under Sections 341, 354(B), 354(D), 354(C), 506 and 509/34 of the Indian Penal Code. The prosecution case is that informant along with her husband was going to her house after purchasing some articles from the market. In the way, husband of the informant stopped his motorcycle and went to attend the call of nature. In the meantime, petitioner came on bike and attempted to make complaint about previous dispute and started to outrage her modesty, when informant raised alarm then her husband came and petitioner fled away from there.
Learned counsel for the petitioner submits that petitioner and the informant are co-villagers and due to grudge and enmity he has
Patna High Court Cr.Misc. No.2093 of 2017 (2) dt.31-01-2017 2/2 falsely been implicated in this case. Moreover, after removal of the misconception the informant and her husband filed an application on 09.01.2017 in the court of Chief Judicial Magistrate, Kaimur to compromise the case.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kaimur at Bhabhua in connection with Bhabhua P.S. Case No. 617 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Rajendra Kumar Mishra, J) manish/- U T
