====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 21-02-2019 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Gopalganj (Town) P.S. Case No. 463 of 2018, instituted for the offence under Section(s) 363, 366A and 365 of the Indian Penal Code.
It is alleged in the written report that daughter of the informant namely Supriya Kumari was living with this petitioner who used to live in the house of Tahir Hussain. It is further alleged that petitioner was the daughter of Hindu family and she got married with Kashim @ Munna and when the informant came to know about this fact, she brought her daughter back to the house, but petitioner always used to call her daughter and then she again went there. It is further alleged that since four days the informant tried to contact her over phone but phone was switched off. The
Patna High Court Cr.Misc. No.75686 of 2018(3) dt.21-02-2019 2/2 informant came to this petitioner on 9.8.2018 and enquired about her daughter, but she did not give any reply. The informant suspected that her daughter may be made traceless for prostitution. The daughter of the informant on recovery has given statement under Section 164 Cr. P.C. which is available in the case diary wherein she has levelled general and omnibus allegation against the petitioner.
Counsel for the petitioner submits that petitioner is lady having no criminal antecedent. She is in custody since 24.8.2018. Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj, in connection with Gopalganj (Town) P.S. Case No. 463 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
