Petitioner is apprehending his arrest in a case registered for offences punishable under Sections 33B, 41 and 42 of the Forest Act.

It has been submitted on behalf of the petitioner that nothing has been recovered from the conscious possession of the petitioner and the tractor from which stone chips were recovered does not belong to the petitioner and the petitioner has no criminal antecedent.
