JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 11-01-2018 Heard learned counsel for the petitioners and learned APP for the State.
The petitioners, in the present case, are seeking regular bail in connection with Brahmpura P.S. Case No 227 of 2017, registered for offences alleged under Sections 25 (1-b)a, 26, 35 of Arms Act.
Learned counsel for the petitioners submits that as per the allegation, one country made loaded pistol was found in possession of Sundaram Kumar (petitioner no. 1), and from possession of petitioner no. 2, one live cartridge has been seized. He further submits that both the petitioners are students, who were apprehended by the police while they were going on motorcycle. Since the motorcycle was in the name of petitioner no. 1 and on
Patna High Court Cr.Misc. No.63746 of 2017 (2) dt.11-01-2018 2/2 demand, papers were produced, the police thereafter, indulged them in the present case on a false accusation. Petitioners have got no criminal antecedent.
Learned APP opposed the prayer for bail.
Considering the facts and circumstances, let the petitioners, above named, be enlarged on bail on their furnishing bail bond of Rs.15,000/- (fifteen thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in connection with Brahmpura P.S. Case No227 of 2017 subject to the conditions U/S 437(3) Cr.P.C.
