SECOND APPEAL No.181 of 2014 ====================================================== Ashok Kumar Sah, ... ... Appellant/s

Versus

Dr. Dinesh Prasad Sah and Ors ... ... Respondent/s ====================================================== Appearance :

For the Appellant/s :

Mr.Jagdish Prasad Bhagat For the Respondent/s :

Mr.

====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR JHA ORAL ORDER 08-08-2019 The plaintiff is the appellant. The appellant filed this second appeal against the acceptance of Pleader Commissioner's report and allotment of share to the plaintiff and the defendant. Admittedly the plaintiff did not file any appeal against the preliminary decree.

Mr. Jagdish Prasad Bhagat, the learned counsel for the appellant submits that the Pleader Commissioner did not take into consideration the objections raised by the appellant with regard to the valuation of the properties and its distribution amongst the plaintiff and defendant in equitable manner but I find from the report of the Pleader Commissioner itself that the appellant did not raise any objection with regard to the valuation of the suit properties and the allotment of share to the plaintiff and defendant, therefore, I do not find any substantial question of law involved in this second appeal.

Accordingly, the second appeal is dismissed.
