1. Heard the parties.
2. The petitioners apprehend their arrest in connection with Triveniganj P.S. Case No. 03 of 2025 dated 02.01.2025 registered under Sections 96 / 3(5) of the B.N.S., 2023.
3. As per the F.I.R. on 01.01.2025 in the evening while the minor daughter of the informant did not return after cutting grass, the informant started searching her in nearby places and came to know that the petitioners and other accused persons have kidnapped her daughter and fled away in a four wheeler.
4. Learned counsel for the petitioners submits that petitioners have not committed any offence in the manner alleged and there was love relation between the petitioner no. 2 and the daughter
Patna High Court CR. MISC. No.45569 of 2025(2) dt.30-07-2025 2/2 of the informant who is aged about 18 years on the basis of medical report. The statement of the victim girl has been recorded under Section 180 & 183 of the B.N.S.S. in which she has stated that she was having love relation with the petitioner no. 2 for the last two years and the parents of the victim wanted to marry her with another boy due to which she on her own free will went with the petitioner no. 2 and performed marriage
5. Regard being had to the submission made by the parties and taking into consideration the statement of the victim girl recorded under Section 180 & 183 of the B.N.S.S., I am inclined to grant anticipatory bail to the petitioners.
6. Let the petitioners, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of A.C.J.M.-I, Supaul in connection with Triveniganj P.S. Case No. 03 of 2025 subject to the condition as laid down under Section 482 (2) of the B.N.S.S. 2023.
