This is an application for bail in connection with Chautham P.S. Case No. 138 of 2017 (Special Case No. 10 of 2017), registered for the offences punishable under Section 20 of N.D.P.S. Act.

Allegation against the petitioner is of recovery of 2.9 kg. of ganja from the house of aunt of petitioner and it said that the house is of the petitioner.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case, having no criminal antecedent and there is no recovery from his house or possession and he is in custody for six months.

Heard learned APP also.

No.62713 of 2017 (2) dt.12-01-2018 2/2 Having heard both sides and in the facts and circumstances of the case, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of 3rd Additional Sessions Judge, Khagaria, in connection with Special Case No. 10 of 2017 (Chautham P.S.Case No. 138 of 2017), subject to the conditions that (1) one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and (2) petitioner will co-operate in trial and appear in court as and when required, except on genuine ground, failing which his bail bond shall be cancelled and (3) if involvement of the petitioner in such type of case is found in future, the prosecution is at liberty to move for cancellation of his bail bond.
