The petitioner seeks bail in connection with Special Case No. 74/2017, arising out of Chowk P.S. Case No. 140/2017 dated 25.05.2017 instituted for the offences under Sections 379, 427, 186, 332, 353, 504, 411, 145, 149 of the Indian Penal Code and Sections 20, 25(a) and 27 of the Narcotics Drugs and Psychotropic Substance Act.
The F.I.R. has been registered on the self-statement of one Inspector of Police alleging that the police team saw a person taking away two bricks from the road towards his home. The police team was also informed about the villagers stealing bricks and steel railing from the road, which had been set up on the eve of Guru festival in the area, for the purposes of erecting makeshift cattle-shade. No sooner, the police party arrived in the village, the father of the
Patna High Court Cr.Misc. No.55964 of 2017 (3) dt.09-01-2018 2/2 petitioner raised alarm and many persons assembled near his house. From the house of the father of the petitioner, many govt. property were recovered. The father of the petitioner had also created disturbance at the time of construction of road for the preparation of the Guru festival. From the house of the father of the petitioner, five trees of Ganja were also recovered.
Learned counsel for the petitioner has submitted that he has been made accused in the present case because of an earlier case lodged by the cousin of the petitioner against the informant and others with respect to an offence under Section 376 of the Indian Penal Code. It has further been submitted that all the recoveries have been made from the house of the father of the petitioner and not from him.
The petitioner has remained in custody since 26.05.2017 and he does not bear any criminal antecedent. For the aforesaid facts, the petitioner above named is directed to be released on bail on his furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge III, Patna in connection with Special Case No. 74/2017, arising out of Chowk P.S. Case No. 140/2017.
