The petitioners, being father and brother-in-law of the husband of the informant, are languishing in custody since 04.08.2018 and 31.08.2018 respectively in connection with Sakri P.S. Case No.94 of 2018 (C.R.I. Case No.1311 of 2018) registered for the offences punishable under Sections 304(B), 201/34 of the Indian Penal Code.
Prosecution case as per the written report of Yogendra Thakur to Sakri P.S. is to the effect that the daughter of the informant Vandana Kumari was married with Hira Lal Thakur on 6.5.2018. After the marriage, there was further dowry demand of a gold chain and a gold ring and for the non-fulfillment of same, they were not allowing the daughter of the informant to visit informant's
Patna High Court Cr.Misc. No.73782 of 2018(3) dt.24-01-2019 2/3 house. Further on 29.06.2018, the informant received on information that his daughter has been killed by all the accused persons including the petitioners and they are planning to dispose of the dead body. After having received the information, when the informant reached at his daughter's in-law house, he came to know that all the accused persons including 5-6 villagers have taken the dead body to dispose it of, whereupon when the informant started searching for them, he found they were disposing of the dead body of his daughter but on seeing the informant, all the accused persons flee away from that place.
It is submitted by learned counsel for the petitioner that the thrust of accusation is against the petitioner and there is no eye witness to the occurrence.
Learned counsel for the State, however, submits that the accusation against the petitioners are demand of dowry and killing the informant's daughter.
Considering the nature of accusation and the fact that thrust of accusation is against the husband of the victim and the investigation has already been concluded, let the above named petitioners be enlarged on bail on furnishing bail bonds of Rs.10000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate,
