JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-06-2019 Petitioner seeks bail in anticipation of his arrest in connection with Noorsarai P.S. Case No. 168 of 2018 registered for the offences punishable under Sections 323, 341, 307 and 504/34 of the Indian Penal Code.
Allegation against the accused persons, including the petitioner is of assaulting the informant.
Submission of learned counsel for the petitioner is that there is no specific allegation of assault attributed against the petitioner and he has no criminal antecedent and he has falsely been implicated in this case due to village politics. It is further submitted that co-accused having similar allegation has been granted anticipatory bail by a co-ordinate Bench of this Court vide order dated 17.12.2018 passed in Cr.Misc.No.66667 of 2018.
Patna High Court CR. MISC. No.73787 of 2018(9) dt.24-06-2019 2/2 Heard learned APP also, who has opposed the prayer for anticipatory bail of the petitioner.
In view of above facts and circumstances, let petitioner, in the event of arrest or surrender before the court below within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nalanda at Biharsharif, in connection with Noorsarai P.S. Case No. 168 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
