JUSTICE ARUN KUMAR ORAL ORDER 13-12-2017 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Sakra PS Case No. 5 of 2017 registered under Sections 447, 448, 341, 323, 307, 384, 387, 506/34 of the IPC and Section 27 of the Arms Act.

Learned Counsel for the petitioner submits that the allegation is that he opened fire from close range but escaped and thereafter hit with the but of the pistol which indicates that no fire was opened and there is no injury of fire arm and the allegation of making demand of extortion is also false, the petitioner is resident of nearby village of the informant and has been in custody since 4.9.2017 and he has got no criminal antecedent except one case under the excise Act. Having considered the said facts and circumstances, the petitioner, namely, Ajit Kumar @ Ajit Mishra is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub Judge 13th -cum-ACJM Muzaffarpur in connection with Sakra PS Case No. 5 of 2017.
