====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 17-01-2019 Heard learned counsel for the petitioner and the State.
The petitioner seeks bail in Chhatapur P.S. Case No. 172 of 2018, instituted for the offence under Section(s) 341, 323, 379, 307, 354, 504 and 506/34 of the Indian Penal Code.
In the written report it is alleged by the informant that on sound of khat-khat the sister-in-law of the informant got awake. She saw few persons in the room. She raised hulla upon which Nunu Mandal @ Rabindra Kumar (petitioner) caused injury to his sister-in-law Soni Kumari on her head by sharp instrument.

Patna High Court Cr.Misc. No.74084 of 2018(3) dt.17-01-2019 2/2 Injury report of Soni Kumari has been enclosed as Annexure-2 wherein the Doctor has found one stabbed wound on frontal region of skull of around 1 cm x 3 cm x 2 cm and one scratch on left forearm. The Doctor has opined injury No. 1 to be grievous in nature caused by sharp cutting weapon and injury No. 2 simple caused by hard and blunt substance. There is no repetition of blow.
Petitioner is in custody since 21.8.2018 having clean antecedent.
Considering the aforesaid facts and circumstances of the case and period spent by the petitioner in custody, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 4th, Supaul, in connection with Chhatapur P.S. Case No. 172 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
