JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-09-2019 This is an application for grant of anticipatory bail in connection with Runnisaidpur P. S. Case No. 770 of 2018, disclosing offences under Sections 302, 120B, 34 of the Indian Penal Code and Section 27 of the Arms Act.

As per the F.I.R, prosecution story is that son of the informant had gone with the petitioner and other accused persons at the work site and it is also alleged that Rs.2,00,000/- of the deceased was due to one Sanjay Jha and there was some altercation between Sanjay Jha and others and later on, his dead body was found at Bandh.

Submission of the learned counsel for the petitioner is that except that petitioner was also accompanied along with the other accused, there is nothing against him. He is also one of the worker along with deceased.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi, in connection with Runnisaidpur P. S. Case No. 770 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with condition that he has to co-operate in the investigation.
