2. Petitioner seeks regular bail in connection with Madhepura PS Case No. 693/2020 registered for the offence punishable under Section 414 of the IPC.

3. The allegation, as per First Information Report, is that the police party intercepted the motorcycle of the petitioner and others and upon query the accused persons disclosed that the motorcycle, on which they were moving, was a stolen one.

4. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedents and he has falsely been implicated in this case only because he was a pillion rider of the said motorcycle which was being driven by one

Patna High Court CR. MISC. No.40429 of 2020(3) dt.16-03-2021 2/2 Abhimanyu Kumar and the petitioner had taken lift from him. Learned counsel further submits that petitioner is a student and reading in Madrsa Aliya at Delhi and he was not aware about the character of the co-accused, Abhimanyu Kumar. Learned counsel submits petitioner is in custody since 09.08.2020.

5. Having regard to the submissions made by the parties and taking into consideration the material on record and the fact that petitioner is in custody since 09.08.2020 having no criminal antecedents, I am inclined to grant regular bail to the petitioner.

6. Accordingly, let the petitioner, MD. ABUJAR KHAN @ CHHOTU @ MD. ABUJAR @ CHHOTU be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in connection with Madhepura PS Case No. 693/2020.

7. It is made clear that at the time of furnishing bail bonds all the parties shall follow the guidelines of social distancing.
