JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-01-2019 The petitioners apprehend their arrest in connection with POCSO Case No. 59 of 2018 arising out of Dinana P.S.Case No. 339 of 2018 registered under Sections 366A/34 of the Indian penal Code and Section 8 of the Protection of Children from Sexual Offences Act.
Allegation as per the FIR is that one Chintu Sharma has kidnapped the minor daughter of the informant and petitioners and other persons have assisted him.
Submission of learned counsel for the petitioners is that FIR itself shows that girl has married with Chintu Sharma and these petitioners have falsely been implicated and they are not related with Chintu Sharma.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioners, abovenamed, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the learned 1st Addl. Sessions Judge-cum-Special Court POCSO Act, Rohtas at Sasaram in connection with POCSO Case No. 59 of 2018 arising out of Dinana P.S.Case No. 339 of 2018 ; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
