JUSTICE ARUN KUMAR ORAL ORDER 13-02-2018 Heard learned Counsel for the petitioners and the State. Petitioners, already in custody, seek bail in Amarpur PS Case No. 165 of 2017 registered under Sections 341, 323, 307, 379, 504/34 and 302 of the IPC.
The allegation in brief is that all the accused persons assaulted the deceased with lathi, danda and iron rod as a result he succumbed to the injuries, Learned Counsel for the petitioners submits that there is general and omnibus allegation against all the accused persons, there was dispute of money with Saheb Mansuri and not with these two petitioners, the FIR was lodged after lapse of four days and the petitioners have clean antecedent.
Having considered the said facts and circumstances, the petitioners, namely, Mahesh Das and Pusi Das @ Khusi Das @ Phusi Das are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Banka in connection with Amarpur PS Case No. 165 of 2017.
