2. The petitioner seeks regular bail in connection with Patarghat P.S. Case No. 227 of 2024 registered for the offence under Sections 96 and 3(5) of the BNS.

3. As per the prosecution case, the petitioner is accused of kidnapping the victim.

4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Petitioner is in custody since 03.04.2025.

5. Learned A.P.P. for the State as well as the learned counsel for the informant have vehemently opposed the prayer

6. Though the allegation against the petitioner is of kidnapping the victim girl but from the statement of the victim girl it appears that the victim girl had eloped with the petitioner on her own and got married to him.

7. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.

8. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned Special Judge, POCSO, Saharsa/concerned Court below in connection with Patarghat P.S. Case No. 227 of 2024.
