====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 08-05-2023 Heard Mr. Umesh Kumar, learned counsel appearing on behalf of the petitioner and Mr. Sanjay Kumar, learned A.P.P. for the State.

2. The petitioner apprehends his arrest in connection with Complaint Case No. 201 of 2019, for the offence punishable under Section 323, 494, 495, 504 & 498(A) of the Indian Penal Code.

3. The case relates to strained relationship between complainant and the petitioner.

4. Learned counsel appearing on behalf of the petitioner submitted that petitioner is ready to live along with the complainant and he will fulfill her physical as well as financial desire.

5. The petitioner is directed to file a joint affidavit before the learned Court below. The learned Court below after accepting the joint affidavit filed on behalf of the complainant and the petitioner may also inquire from the complainant as to whether she is ready to live with the petitioner willfully.

6. In case the parties are ready to live together, the petitioner, above named, is directed to be released on prearrest bail, provisionally, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Arwal in connection with Complaint Case No. 201 of 2019, subject to the condition that the petitioner and O.P. No.2, who are husband and wife, will try to resolve their matrimonial dispute amicably and gain respect in the society as well as in the eye of their parents, if no complain is made by either party, the provisional bail granted to the petitioner shall be made absolute after completion of period of one year on such terms and conditions the Court below deems fit and proper.
