JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-10-2019 Petitioner seeks bail in anticipation of his arrest in connection with Kateya P.S. Case No. 114 of 2019, registered for the offences punishable under Sections 341, 323, 354-B of the Indian Penal Code.
As per F.I.R. allegation against the petitioner is that he tried to outrage the modesty of the informant and also snatching away Mangalsutra.
Submission of the learned counsel for the petitioner is that allegation is false and concocted and he has been made accused in this case due to village rivalry and he has no criminal antecedent.
In this case case diary was called for vide oder dated 16.07.2019 which has been received on 23.09.2019 but the case
Patna High Court CR. MISC. No.43472 of 2019(5) dt.21-10-2019 2/2 diary contains only the investigation upto 6.4.2019 even statement of victim girl has not been recorded. In view of the facts as discussed above, this application is disposed of with a direction to the petitioner that he surrender before the learned Court below by 14.11.2019 then he will be released on provisional bail by the learned court below on its own satisfaction and learned court below shall call for entire update case diary and considering the material available on record he will pass an appropriate order either confirming the provisional bail or cancelling the provisional bail granted to the petitioner.
