2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 341 , 323 , 504, 353 and 34 of the Indian Penal Code .
3. As per the prosecution case, allegation against this petitioner is that he forcibly entered with heavy truck into no entry zone and he also smoke on the face of informant and snatched whistle code from robe of informant.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case . As a matter of fact, petitioner did not have any light vehicle or heavy vehicle and as such there is no question of
Patna High Court CR. MISC. No.49301 of 2024(2) dt.08-08-2024 2/2 crossing the no traffic zone . Petitioner has not committed any offence as alleged in the F.I.R. Petitioner claims clean antecedent.
5. Learned counsel for the State opposes the prayer for bail and submits that there is specific allegation against the petitioner that he forcibly entered into no traffic zone with heavy truck and he smoke on the face of informant and also snatched whistle code from robe of informant who is lady constable in Bihar Police .
6. Considering the nature of accusation and gravity of offence , prayer for pre-arrest bail of the petitioner is rejected. (Prabhat Kumar Singh, J) Koushik/- U T
