JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 20-07-2021 As prayed for, let the learned counsel appearing for the petitioners remove the defect(s), as pointed out by the office vide its notes dated 26.12.2020, within four weeks of starting of Court proceeding in physical mode in normal course. Heard learned counsel for the petitioners and the learned A.P.P. for the State through video conferencing. The petitioners apprehend arrest in connection with Majhauliya P.S. Case no. 485 of 2020, registered under Sections 341, 323, 498(A), 504, 506 and 380/34 of the Indian Penal Code and Section 3 and 4 of the Dowry Prohibition Act. The accusation is that marriage of informant Soni Devi was performed with Saurabh Pandey, son of Jai Prakash
Patna High Court CR. MISC. No.39931 of 2020(2) dt.20-07-2021 2/3 Pandey, resident of village-Jai Prakash Nagar, P.S. Bettiah Muffasil, District-West Champaran, while she was kept properly in her matrimonial house for about two months, but, thereafter, she was being tortured for demand of Alto Car giving threatening to remarriage of her husband Saurabh Pandey after killing her, due to fear, on 12.03.2020, she left her matrimonial house along with ornaments and narrated the incident to her parents. Thereafter, Panchayati was arranged in which Jai Prakash Pandey (petitioner No.1), again, made demand of Alto car then assurance was given to give Alto car after ten months. On 02.07.2020 her husband and in-laws, boarding on Bolero vehicle, reached at her parental house. In the night all tried to press her neck, but, on hulla, her family members rushed there then all moved from there snatching her ornaments.
Learned counsel for the petitioners submits that, in fact, petitioners are father-in-law and mother-in-law of the informant. Further submission is that, in fact, informant willingly left her matrimonial house and used to reside at her Myaka, while petitioners and their other family members went at her Myaka to take her in Bidai, but, all were abused regarding which Bettiah (Muffasil) P.S. Case No.402 of 2020,
Patna High Court CR. MISC. No.39931 of 2020(2) dt.20-07-2021 3/3 under Sections 147, 148, 149, 323, 324, 427, 380, 504 and 506 of the Indian Penal Code against parents of the informant of the present case and others. The petitioners have no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Bettiah, West Champaran in connection with Majhauliya P.S. Case No. 485 of 2020, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
