337 bags of cement are said to be lying in the shop of the petitioner since 1983. The rent for the same was claimed by the petitioner in the Title Suit No. 147 of 1991 which was allowed. The present application seeks permission of the respondents for removal of those 337 bags of cement which have now turned into stone.
Mr. Thakur states that since the said bags of cement as of today is of no use, he will remove them and stack outside the shop or any convenient place assigned by the respondent. Counsel for the State, on appreciating the facts of the
Patna High Court CWJC No.18476 of 2012 (3) dt.04-01-2016 2/2 case, has submitted that the respondent State shall have no objection in doing so by the petitioner.
Recording the aforesaid submission of the petitioner and the stand of the respondent State, the writ application is disposed of.
