The petitioners have prayed for bail in a case instituted for the offence under Sections 406, 420, 467, 468, 469 and 471 of the Indian Penal Code.

AS per allegation in the FIR, informant withdrawn an amount of Rs. 22,000/- from the Central Bank of India, Pipra Branch. Two miscreants came to him and developed intimacy towards the informant as his wife is ill and they assured him that they will help in treatment of his wife. At the time of exiting, miscreants gave him a bundle of cash of Rs. 1,50,000/- wrapped

No.44763 of 2023(2) dt.28-07-2023 2/3 in handkerchief and instead they took cash of Rs. 22,000/- from the informant and hurridely they went away from there with two other miscreants by motorcycles. When the informant untied the handkerchief, he found only bundle of plain papers in the shape of notes and lodged an FIR against four unknown persons. It is submitted by learned counsel for the petitioners that petitioners have been falsely implicated in this case. They have committed no offence. They are not named in the FIR. Only on the basis of suspicion, their names have been dragged in the present case. After prevailing good sense, the matter has been compromised out of the court between both the parties and compromise petition is annexed to this petition as Annexure-2. Petitioners have got no criminal antecedent and languishing in judicial custody since 11.5.2023.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) each with two sureties of the like amount each to the satisfaction of the learned
