JUSTICE MOHIT KUMAR SHAH ORAL ORDER 13-02-2023 Though the present writ petition has been filed seeking to challenge the order dated 06.06.2003 passed by the District Magistrate, Vaishali by which the arms license of the petitioner bearing Licence No.1897/91 has been cancelled as also order dated 29.11.2006, passed by the learned Commissioner, Tirhut Division in Muzaffarpur in Case No.42 Arms Appeal/2003-2004 whereby and whereunder the appeal has been dismissed, but the learned counsel for the petitioner, at the outset, seeks liberty on behalf of the petitioner to apply afresh for grant of arms licence in accordance with the provisions contained in the new Arms Rules, 2016, however, it is prayed that that the petitioner's arms, i.e., Double Barrel N.P. Bore Rifle be not disposed of by the respondent authorities.

Patna High Court CWJC No.3961 of 2007(5) dt.13-02-2023 2/2 Accordingly, the present writ petition stands disposed off with liberty to the petitioner to apply afresh for grant of a new arms licence, however, with a direction to the District Magistrate, Vaishali/Begusarai not to dispose of the aforesaid rifle of the petitioner, in case the same has not already been disposed of and preserve the same till the application, to be filed by the petitioner, for grant of arms licence, within a period of four weeks from today, is disposed off.
