The petitioner seeks regular bail in connection with Bihar P.S. Case No.468 of 2016 registered for the offences punishable under Sections 323, 341, 324, 504, 506, 325, 379, 307/34 of the Indian Penal Code and Section 27 of the Arms Act. It is alleged that on 24.10.2016 this petitioner and two others assaulted the informant and his father by means of iron rod and further took away his motorcycle. It has been submitted that one of the co-accused Suraj Kumar, who had assaulted the father of the informant by means of iron rod, has entered into compromise. The informant and other injured appeared before the Court of Chief Judicial Magistrate, Nalanda at Biharsharif and
Patna High Court Cr.Misc. No.57199 of 2017 (2) dt.13-12-2017 stated that accused Suraj Kumar had not assaulted with an intention to kill them. The said Suraj Kumar has been allowed bail by the learned court below. The injuries allegedly caused on the informant and his father are simple in nature. The petitioner is in custody since 30.08.2017.
The learned A.P.P for the State opposed the submission. Considering the facts and circumstances of the case, the prayer of bail is allowed. The petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Bihar P.S.
