2. The petitioner seeks regular bail in connection with Sasaram (T) P.S. Case No. 309 of 2024 dated 20.03.2024, lodged under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022.

3. Learned counsel for the petitioner submits that the bail application of the petitioner was earlier rejected vide order dated 27.05.2024 passed in Cr. Misc. No. 38722 of 2024. Counsel submits that charge has already been framed in this case. Counsel further submits that on earlier occasion, report about the present status of trial has been called for and from the

No.46633 of 2024(3) dt.30-08-2024 2/3 said report, it transpires that out of four charge sheet witnesses, two witnesses have been examined and process issued against rest witnesses. Counsel submits that the criminal antecedent of the petitioner is not clean as there are four criminal cases pending against him in which in all the cases, he is on bail. The petitioner is in custody since 21.03.2024. Counsel further submits that no purpose shall be solved keeping the petitioner in custody.

4. Learned APP for the State opposes the prayer for bail of the petitioner.

5. In the present facts and circumstances of this case, let the petitioner above named, be granted bail as well as on being satisfied by the Trial Court that the petitioner is not absconding in any of the cases pending against him whose details are mentioned below, and on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No.2-cum-Additional District and Sessions Judge, Rohtas at Sasaram in connection with Sasaram (T) P.S. Case No. 309 of 2024, subject to the conditions as laid down U/s 437(3) Cr.P.C.
