JUSTICE MADHURESH PRASAD ORAL ORDER 17-02-2018 Heard counsel for the petitioner and APP for the State. Petitioner is an accused in a case registered for offence under sections 363,366/34 IPC.

It is submitted on behalf of the petitioner that as per the specific allegation in the FIR and in the statement of the victim under section 164 Cr.P.C. the victim was kidnapped by one Md. Guddu Alam and Majharul and for a brief period she was kept at the house of the petitioner. Petitioner has no antecedent and is in custody since 7.10.2017, though charge sheet has already been submitted in the case. Similarly situated co-accused Md. Mazharul @ Majahrul, Guria Khatoon and Bibi Kausari have already been granted bail vide order dated 7.2.2018, passed in Cr Misc No. 63393 of 2017.

In the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named

Patna High Court Cr.Misc. No.63443 of 2017 (3) dt.17-02-2018 2/2 be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea in Amour Police Station Case No. 137 of 2017 on the following conditions:- (a) One of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner.

(b) He/she will be well represented on each date and if he/she fails to do so on two consecutive dates, his/her bail will be liable to be cancelled.
