The petitioner is in custody in connection with S.T. No. 447 of 2018 Sasaram (Muf.) P.S. Case No. 44 of 2018 for the offences under Section 302/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner has no criminal history. In this case, case diary was called for.

Learned counsel for the State submits that from perusal of the case diary it appears that there is no eye witness to the place of occurrence but the petitioner was last seen with the victim and on that basis he has been made accused in the case.

Considering the period of custody and the fact that

No.72259 of 2018(3) dt.10-01-2019 2/2 petitioner has no criminal history and allegation against the petitioner is that he was last seen with the victim, the petitioner, named above, is directed to be released on bail after 21.03.2019 on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Learned Additional Sessions Judge-7th, Rohtas at Sasaram in connection with S.T. No. 447 of 2018 Sasaram (Muf.) P.S. Case No. 44 of 2018.
