JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Daraunda (M.H. Nagar) P.S. Case No. 100 of 2016 registered under Section-7 of Essential Commodities Act. The seized grains were recovered from godown of one Pradeep Kumar. The aforesaid godown was given to Pradeep Kumar on rent by co-accused Md. Sabib. So far as petitioner is concerned; it is stated that he was found residing in the same premises and used to help the aforesaid Pradeep Kumar in storage of illegal grains. However, co-accused Md. Sabib has already been granted privilege of anticipatory bail by a coordinate bench of this court.

No.42918 of 2016 (3) dt.28-11-2016 2/2 Accordingly, this anticipatory bail petition is allowed and it is ordered that the petitioner named above, in the event of his arrest or surrender in the court below within four weeks from the date of receipt/production of copy of this order, shall be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Daraunda (M.H. Nagar) P.S. Case No. 100 of 2016 to the satisfaction of learned Chief Judicial Magistrate, Siwan subject to condition as laid down u/S 438(2) of the Code of Criminal Procedure Code.
