The petitioner apprehends his arrest in connection with Nawada Town P.S. Case No. 279 of 2016 registered under Sections 341, 323, 307, 379, 147, 148, 504 and 506 of the Indian Penal Code.
The accusation is that the informant, Arjun Kewat, named 15 persons including the petitioner with allegation that due to election rivalry petitioners along with others named in the F.I.R. came at his door armed with lathi, danda, stones and iron rod and started to abuse him. At that time, this petitioner gave iron road blow at his head. When his son, Raj Kumar and Rita Devi rushed to save him then both were also assaulted through lathi and stick.
Patna High Court Cr.Misc. No.47021 of 2016 (2) dt.13-12-2016 In the meantime, they also took ornaments and other articles worth Rs.2,00,000/- and Rs.5000/- cash on the point of pistol. Learned counsel for the petitioner submits that while there is allegation against the petitioner to cause injury at the head of the informant but only one injury was found at his head, which is simple in nature caused by hard and blunt substance. It is further submitted that petitioner has no criminal antecedent. Considering the aforesaid submissions, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawada, in connection with Nawada Town P.S. Case No. 289 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
