JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 06-12-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Gopalpur P.S. Case No. 54 of 2017, registered under Sections 120(B), 302 and 201 of the Indian Penal Code. The accusation is of killing the daughter of the informant by her husband and in-laws by pressing her neck and also to dispose of her dead body with intention to conceal the evidence.

Learned counsel for the petitioner submits that, in fact, daughter of the informant committed suicide due to quarrel with her husband after performing the re-marriage by her husband,

No.56470 of 2017 (2) dt.06-12-2017 Harendra Das, and petitioner, who is the mother-in-law of the deceased, has no role in the occurrence, but with ulterior motive the petitioner has falsely been implicated in this case. Moreover, the husband of the deceased is already in custody. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of her arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bettiah, West Champaran, in connection with Gopalpur P.S. Case No. 54 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
