JUSTICE ARUN KUMAR ORAL ORDER 03-04-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Muffasil P.S.Case No. 432 of 2017 registered under Sections 366A of the Indian penal Code.

Allegation in brief is that petitioner along with others kidnapped the daughter of the informant while returning back after attending the call of nature.

Submission is that statement of the girl (Annexure-2) clearly shows that it was a case of elopement, she had herself gone along with the petitioner and she does not speak about any sexual exploitation and the petitioner is in custody since 17.09.2017. Having considered the aforesaid facts and circumstances, the petitioner, namely , Bibhishan Kunwar @ Bibhishan Sharma

Patna High Court Cr.Misc.
