JUSTICE SUDHIR SINGH ORAL ORDER 22-04-2019 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the opposite party No.2. The petitioner seeks bail in a case registered under Section 304(B), 201 of the Indian Penal Code.

Allegation is that the accused persons including the petitioner caused death of the daughter of the informant due to non-fulfilment of demand of dowry.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 16.04.2018 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been made accused due to mistake of fact. A petition has been filed in the court below by the

Patna High Court CR. MISC. No.72626 of 2018(5) dt.22-04-2019 2/2 informant regarding the same. Said application is Annexure 2 to the present application.

On behalf of the State and the counsel for the opposite party No.2, it is submitted that the petitioner is named in the complaint case/F.I.R. Counsel for the opposite party No.2 does not controvert the application filed by him vide Annexure 2 to the present application.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. X, Vaishali at Hajipur in connection with Patepur P.S. case No.48 of 2016.
