JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-02-2019 The petitioner seeks bail in connection with K.Nagar P.S.Case No. 405 of 2012 registered under Sections and 120B and 302/34 of the Indian Penal Code and 27 of the Arms Act. Earlier prayer for bail of the petitioner was twice rejected vide order dated 19.07.2017 and 28.03.2018 passed in Cr. Misc. No. 53242 of 2016 and Cr. Misc. No. 13382 of 2018 respectively.
Submission of learned counsel for the petitioner is that there is no substantive progress in the trial and petitioner is in custody since 06.09.2016.
Heard learned A.P.P also and perused the report from which it appears that four witnesses have been examined up till now and date has been fixed for 07.02.2019 for examination of another witnesses and also reported that trial may be concluded within a period of six months.
Patna High Court Cr.Misc. No.76595 of 2018(4) dt.07-02-2019 2/2 In such view of the matter, I am not inclined to grant privilege of bail to petitioner. However, trial court is directed to expedite the trial and conclude the same within the period as specified by him on day to day basis.
This application is dismissed with the aforesaid observation.
