The petitioners apprehend their arrest in connection with Complaint Case No. 240 of 2017 registered under Sections 467, 468, 472, 473, 420 and 120B of the Indian Penal Code. Learned counsel appearing on behalf of the petitioners submits that petitioners are innocent and have falsely been implicated in the present case. Further submission is that one Ban Bihari Banerjee, executed sale deed dated 06.02.2007, in favour of wives of the petitioners and their names were mutated vide Mutation Case No. 1864/2010-11, as contained in Annexure-2 'Series' to the bail application. The D.C.L.R.,

Patna High Court CR. MISC. No.40621 of 2020(4) dt.18-11-2021 2/2 Naugachia, disposed of Mutation Appeal No. 11/2017-18, confirming the possession of wives of the petitioners vide Annexure-3 to the bail application. Petitioners have no criminal antecedent.

Having considered the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of the A.C.J.M., Naugachia, Bhagalpur in connection with Complaint Case No. 240 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.
